🌺 सरोगेसी बिल 🌺

🌻 लोकसभा में 19 दिसंबर 2018 को सरोगेसी (नियामक) विधेयक को पारित हुआ था। भारत में सरोगेसी से उभरने वाली समस्याओं से निपटने के लिए यह विधेयक लाया गया है.

यह विधेयक व्यावसायिक सरोगेसी और इससे जुड़े अनैतिक कार्यों पर रोक लगाएगा. विधेयक में राष्ट्रीय एवं राज्य सरोगेसी बोर्ड गठित करने की बात कही गई है. इसके अतिरिक्त सरोगेसी के नियमन के लिए अधिकारियों के नियुक्ति की जाएगी.

✅ ️उद्देश्य:

यह विधेयक लाने का उद्देश्य भारतीय महिलाओं को उत्पीड़न से बचाना है. इस बिल के माध्यम से सरोगेट जननी तथा उससे उत्पन्न बच्चे के अधिकारों की सुरक्षा की जाएगी.

❇ ️विधेयक से संबंधित मुख्य तथ्य:

•   यह विधेयक केवल उन्हीं जोड़ों को सरोगेसी की अनुमति देगा जो बच्चा नहीं जन सकते.

•   विधेयक के मुताबिक सरोगेसी का लाभ उठाने के इच्छुक व्यक्तियों को भारतीय होना होगा और उनकी शादी के कम से कम पांच साल हुए हों. इसके अलावा जोड़े में से किसी एक को यह साबित करना होगा कि वह बच्चा जनने की स्थिति में नहीं हैं.

•   सरोगेसी के लिए बनाए जा रहे प्रावधानों का उल्लंघन करने पर बिल में कठोर सजा का भी प्रावधान किया गया है.

•   इस बिल में राष्ट्रीय सरोगेसी बोर्ड तथा राज्य सरोगेसी बोर्ड की स्थापना के लिए प्रावधान है.

•   इस बिल के अनुसार समलैंगिक तथा एकल अभिभावकों को सरोगेसी की अनुमति नहीं होगी तथा जिस दंपत्ति के पहले से बच्चे हैं वे भी सरोगेसी का उपयोग नही कर सकते.

•   इस बिल के अनुसार कोई महिला जीवन में केवल एक बार ही सरोगेट कर सकती है, उसकी उम्र 25 से 35 के बीच होनी चाहिए.

•   सरोगेसी से उत्पन्न बच्चे की कस्टडी प्रथम श्रेणी के मेजिस्ट्रेट (अथवा इससे ऊपर का अधिकार) द्वारा पारित की जायेगी.

❇ ️सरोगेसी क्या है?

सरोगेसी का मतलब है किसी और की कोख से अपने बच्चे को जन्म देना. अगर कोई पति-पत्नी बच्चे को जन्म नहीं दे पा रहे हैं, तो किसी अन्य महिला की कोख को किराए पर लेकर उसके जरिए बच्चे को जन्म देना सरोगेसी कही जाती है. जिस महिला की कोख को किराए पर लिया जाता है, उसे सरोगेट मदर कहा जाता है.

❇ ️सजा का प्रावधान:

सरोगेसी बिल के मुताबिक इसके नियमों को काफी कठोर बना दिया गया है. अगर सरोगेसी के ये प्रावधान तोड़े गए तो इसके इच्छुक दंपती और सरोगेट मां को क्रमशः कम से कम 5 साल और 10 साल तक की सजा हो सकती है. इसके अलावा 5 लाख तक और 10 लाख का जुर्माना भी लगाया जा सकता है. अगर कोई मेडिकल प्रैक्टिशनर इसके नियमों को तोड़ता पाया गया तो उसे कम से कम 5 साल की सजा और 10 लाख तक का जुर्माना देना पड़ सकता है.

  Why in News Recently,  Hindustan Aeronautics Ltd   (HAL) delivered the  heaviest semi-cryogenic propellant tank  (SC120- LOX) to the  Indian Space Research Organization (ISRO).
